Right of withdrawal and exclusion for custom-made products
Consumer right of withdrawal for standard goods
Consumers generally have a statutory right of withdrawal for distance contracts concerning non-personalised standard goods, unless a statutory exception applies.
The withdrawal period is generally 14 days from the legally relevant starting point. To exercise the right of withdrawal, the consumer must inform FoodyPack.de, Habip Sen, Pleikartsförster Str. 1, 69124 Heidelberg, Germany, email: info@foodypack.eu, phone/WhatsApp: +49 163-3658074, by means of a clear statement of the decision to withdraw from the contract. The electronic withdrawal function provided in the shop may also be used.
Exclusion of the right of withdrawal for custom-made products
Under Section 312g(2) No. 1 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts concerning goods that are not prefabricated and for whose manufacture an individual choice or specification by the consumer is decisive, or which are clearly tailored to personal needs.
This applies in particular to individually printed, customer-specific packaging or packaging produced following customer approval. There is no statutory right of withdrawal for such products, and Foodypack does not grant any voluntary right of return, exchange or cancellation. Cancellation is excluded after binding approval or the start of production unless Foodypack expressly confirms otherwise in writing.
Business customers
Business customers within the meaning of Section 14 BGB do not have a statutory consumer right of withdrawal.
Consequences of a valid withdrawal for standard goods
In the event of a valid withdrawal, we will reimburse the payments owed under the applicable statutory provisions. The consumer bears the direct cost of returning the goods where this is legally permissible and the consumer has been properly informed thereof.
Rights in the event of defects
The provisions concerning withdrawal and voluntary returns do not affect statutory rights relating to defective, damaged or incorrectly delivered goods.
